本公约各缔约国同意如下：
第一条
为了本公约各条款的目的，<
/p>
“
大陆架
”
一词
是用以指：
1
、邻接海岸但在领海范
围以外，深度达
200
米或超过此限度而上覆水域的深度
容许开采其自然资源的海底区域的海床和底土；
2
、邻近岛屿海岸的类似的海底区域的海床的底土。
第二条
一、沿海国为了勘探和开采自
然资源的目的，对大陆架行使主权权利。
二、
第一款所指的权利是专属性的，
即：
如果沿海国不勘探
大陆架或开采其自然
资源，
任何人未经沿海国的明示同意，
均不得进行这种活动，
或对大陆架提出权
利
主张。
三、沿海国对大陆架的权利不决定于有效或象征的占领
或任何明文公告。
四、
本公约各条款
所指的自然资源包括海床和底土的矿物和其他非生物资源，
以
及
属于定着种的生物，
即在可收获阶段在海床上或海床下不移动或除与海床或底
土经常实体接触外不能移动的生物。
第三条
沿海国对大陆架的权利不影响
上覆水域作为公海的法律地位，也不影响
此项水域上空的法律地位。
第四条
沿海国家除了勘探大陆
架和开采其自然资源有权采取合理措施外，对于
在大陆架上铺设或维持海底电缆或管道不
得加以阻碍。
第五条
一、勘探大陆架和开采其自然资源不应使航行、捕鱼或海洋生物资源的
养护受
到任何不当的干涉，
或使以公开发表为目的的基础海洋学或其他科学研究
受到任何干涉。
二、
在本条
第一和第六两款规定的限制下，
沿海国有权在大陆架上建造和维持或
经营为勘探大陆架和开采其自然资源所必要的装置或其他设施，
并在此种装置及
设施周围设立安全区和该区内采取保护这种装置和设施的必要措施。
三、
第二款所指的安全区得伸延到已建立的这种装置及其他设施
周围从其外缘算
起
500
米的距离。所
有国籍的船舶均须尊重这些安全区。

四、
这种
装置及设施虽受沿海国的管辖，
不具有岛屿的地位。
这种装置及
设施没
有自己的领海，而且其存在也不影响沿海国领海的划界。
五、
任何这种装置的建造必须妥为通知，
并对其存在必须维持永久性的警告方法。
已被放弃或不再使用的任何装置必须全部撤除
。
六、
不论装置和设施或其周围的安
全区，
均不得设立在可能干扰国际航行必经的
公认海道的使用的
地方。
七、
沿海国有义务在安全区内
采取一切适当措施，
以保护海洋生物资源不受有害
物剂的损害。
八、任何有关大陆架的研究或在大陆架上进行的任何研究应取
得沿海国的同意。
但是，
如果一个合格机构提出请求，
对大陆架的物理或生物特征进行纯科学的研
究，
沿海国在通常情形下不应拒绝同意，
但沿海国如果愿意，
应有权
参加或有代
表参与这种研究，而在任何情况下，研究结果应予公布。
第六条
一、如果同一大陆架邻
接两个或两个以上海岸相向的国家的领土，属于
这些国家的大陆架的疆界应由这些国家之
间的协定予以确定。
在无协定的情形下，
除根据特殊情况另定疆
界线外，
疆界是一条其每一点与测算各国领海宽度的基线
的最近
点距离相等的中间线。
二、
如果同一
大陆架邻接两个相邻国家的领土，
大陆架的疆界由两国之间的协定
予以决定。
在无协定的情形下，
除根据特殊情况另定疆界线外
，
疆界应适用与测
算各国领海宽度的基线的最近点距离相等的原
则予以决定。
三、
在划定大陆架疆界
时，
按照本条第一和第二两款所载的原则划定的任何线均
应参照
一定日期所存在的海图和地形予以确定，
同时应参照陆地上永久固定的标
明点。
第七条
本公约各条款不应妨碍沿海国开凿隧道以开发底土的权利，而不问底土
上水
域的深度。
第八条
本公约在
1958
年
10
月
31
日以前，
应
对所有联合国会员国或任何专门机
构成员国，以及联合国大会邀请为本公约缔约国的国家
，开放签字。
第九条
本公约须经批准。批准书应交存于联合国秘书长。
第十条
本公约应对属于第八条所载任
何一类的任何国家开放加入。加入书应交
存于联合国秘书长。

第十一条
一、
本公约应自第
22
份批准书或加入书交存于联合国秘书长之日
后第
30
天开始生效。
二、对于在第
22
份批准书或加入书交存以后批准或
加入本公约的第一国家，本
公约应在该国将批准书或加入书交存后第
30
天对该国开始生效。
第十二条
一、在签字、批准或加入时
，任何国家均得对第一条至第三条以外的
其他条文作出保留。
二、
依照第一款对本公约条文作出保留的任何缔约国，
得随时通知联合国秘书长
撤销该项保留。
第十三条
一、自本公约生效之日起五
年时期届满后，任何缔约国得随时以书面
通知向秘书长提出修改本公约的要求。
二、联合国大会对上述要求如果采取步骤，应决定将采取的步骤。
第十四条
联合
国秘书长应将下列事项通知所有联合国会员国以及第八条所指的
其他国家：
1
、依照第八、第九和第十各条，关于对本公约的
签字以及批准书与加入书的交
存；
2
、依照第十一条，关于本公约的生效日期；
3
、依照第十三条，关于修改的要求；
4
、依照第十二条，关于对本公约的保留。
第十五条
本公约原本应交存于
联合国秘书长，其中文、英文、法文、俄文及西
班牙文五种文本均有同等效力，
秘书长应将经证明无误的本公约副本分送第八条
所指的所有国家。
为此，下列全权代表，经各自政府正式授权，在本公约上签字，以资
证明。

CONVENTION ON THE CONTINENTAL SHELF.

The States Parties to this Convention
Have agreed as follows:
Article 1
For the purpose
of these articles, the term
ed as
referring (a) to the seabed and subsoil
of the submarine areas adjace
nt to
the coast but outside the area of the
territorial sea, to a depth of
200
metres or, beyond that limit, to where
the depth of the superjacent w
aters
admits of the exploitation of the
natural resources of the said areas
;
(b)
to the seabed and subsoil of
similar submarine areas adjacent to the

coasts
of islands.
Article 2
1. The coastal
State exercises over the continental shelf
sovereign r
ights
for the
purpose of exploring it and exploiting its natural
resources.
2. The rights
referred to in paragraph 1 of this article are
exclusiv
e in
the sense that
if the coastal State does not explore the
continental
shelf
or
exploit its natural resources, no one may
undertake these activiti
es, or
make a claim to the continental shelf,
without the express consent of
the
coastal State.
3. The rights of the coastal State over
the continental shelf do not
depend
on occupation, effective or notional,
or on any express proclamation.
4. The natural resources referred to in
these articles consist of the
mineral
and other non-living resources of the seabed and
subsoil toge
ther

with living
organisms belonging to sedentary species, that is
to say,
organisms which, at the
harvestable stage, either are immobile on or
under
the seabed or are
unable to move except in constant physical contact
with
the seabed or the
subsoil.
Article 3
The rights of
the coastal State over the continental shelf do
not aff
ect
the legal status
of the superjacent waters as high seas, or that of
t
he
airspace above those
waters.
Article 4
Subject to its
right to take reasonable measures for the
exploration
of the
continental shelf and the exploitation
of its natural resources, the
coastal
State may not impede the laying or maintenance of
submarine c
ables
or pipe
lines on the continental shelf.
Article 5

1. The exploration of the continental
shelf and the exploitation of i
ts
natural resources must not result in
any unjustifiable interference w
ith
navigation, fishing or the conservation
of the living resources of th
e sea,
nor result in any interference with
fundamental oceanographic or othe
r
scientific research carried out with
the intention of open publicatio
n.
2. Subject to the
provisions of paragraphs 1 and 6 of this article,
t
he
coastal State is
entitled to construct and maintain or operate on
the
continental shelf installations
and other devices necessary for its
exploration and the exploitation of its
natural resources, and to est
ablish
safety zones around such installations
and devices and to take in tho
se
zones measures necessary for their
protection.
3. The safety
zones referred to in paragraph 2 of this article
may ex
tend
to a distance of
500 metres around the installations and other
device
s
which have been
erected, measured from each point of their outer
edge
