第七十六条

下列事项由业主共同决定：

(

一

)

制定和修改业主大会议事规则；

(

二

)

制定和修改建筑物及其附属设施的管理 规约；

(

三

)

选举业 主委员会或者更换业主委员会成员；

(

四

)

选聘和解聘物业服务企业或者其他管理人；

(

五

)

筹集和使用建筑物及其附属设施的 维修资金；

(

六

)

改建、重建建筑物及其附属设施；

(

七

)

有关共有和共同管理权利的其他重大事项。

决 定前款第五项和第六项规定的事项，

应当经专有部分占建筑物总面积三分之二以上的

业主且占总人数三分之二以上的业主同意。

根据本条规定，建筑区划内的下列事项需由业主共同决定：

(

)

制定和修改业主大会议事规则。业主大 会议事规则是业主大会组织、运作的规程，

需要由业主共同决定。

)

制定和修改建筑物及其附属没施的 管理规约。建筑物及其附属设施的管理规约是业

主自我管理、自我约束、自我规范的规则 约定，应当由全体业主共同制定和修改。

三

)

选举业主委员会或者更换业主委员会成员。

业主通过业主大会选举能够代表和维护

自己利益的业主委员会委员，成立业主委员会。 对不遵守管理规约，责任心不强，

不依法履

行职责的委员予以更 换。

)

选聘和 解聘物业服务企业或者其他管理人。

物业服务机构或者其他管理人的管理水
