4.2

4.3

After the tenth month of the
tenancy, the Tenant may terminate this
said Agreement by giving the
Landlord
two (2) calendar months notice in writing, and
agree the
landlord to show the
apartment to potential tenant.
在乙方付清本合同项下规定其应该支付的费用后十五个工作日内全额无息将
二个
月保证金如数归还乙方。如乙方在已经办理了退房手续支付所有的费用
后十五个工作日内
未收到甲方归还的全额押金,则视为逾期未归还押金,每
逾期一天超出归还日期后未支付

5.2
乙方应提前支付甲方每月的租金,应在每月的第

乙方应以人民币形式支付租金。甲方需提供租金的付
款通知单予乙方。

shall
be
unpaid
for
seven

days
after

rent
shall
become

liable
to
pay
a
late
penalty fee equal to 3% of the rent per day. If
the rent has
not been paid more than 15
days after the due date, Party B will
be
deemed
to
have
automatically
terminated
the
tenancy
resulting
in
a
breach
of
this
Agreement.
Party
A
will
then
be
entitled
to
take
back
the
leased
property
and
have
recourse
against
Party
B
for breach of contract.

为确保租赁房屋及其设施之安全与完好及租
赁期内相关费用之如期结算,乙
方应在甲方提供该租赁房屋的产权证复印件

To ensure the welfare and
good condition of the leased property as
well
as
the
prompt
payment
and
settlement
of
all
related
charges
during
the
term
of
the
tenancy,
Party
B
agrees
to
pay
Party
A
security deposit equal to
two months
’
rent and
management fee in
the amount of RMB
as security for Party
B’s hereunder
once the copy of
ownership certificate
(or pre-sell
/
pre-lease
permit)
of
the
premises
is
provided.
Party
A
shall
provide the formal
receipt to Party B within 7 working days after
receiving the deposit.
除合同另有约定之外,甲方应于租赁期满或此合同提前终止之日且双方确认
该租赁房屋的归还和乙方付清所有相关费用后的十五个工作日内将保证金全
额无息退还乙
方。
Unless otherwise provided
in this Agreement, Party A shall return
to
Party
B
the
entire
security
deposit
without
interest
in
15
working
days
after
expiration
of
the
tenancy
or
early
determination
of
this
Agreement
and
both
parties
have
confirmed
the
return
of
the
premises
and
Party
B
has
paid
all
related
outstanding fees.
6.3
甲方因乙方违反本合同的规定而受的损失,可在保证金中扣抵合
理数目,不足部分乙方必须在接到甲方付款通知后十天内补足。
Party A may deduct a reasonable amount
of security deposit towards
payment
of
any
actual
damages
Party
A
shall
have
incurred
or
suffered
as
a
result
of
Party
B’s
breach
of
this
Agreement.
If
the
security
deposit
is
not
sufficient
to
cover
such
amounts,
Party B must pay
the deficiency within 10 days of the receipt of a
demand from Party A.
七、
其他费用:
Other Charges:

乙方应承担租赁期内的水、电、煤气、电话费、宽带月租费等,并按上海市公共事
业局的帐单如期缴纳。
Party
B
is
responsible
for
paying
water,
gas,
electricity,
telephone
charges and
broadband monthly fee. Such charges shall be paid
when due
according to the bills from
Shanghai Utility Bureau therefor received by
Party B.

出租人的责任

8.1
甲方须按时将租赁房屋以良好可租赁状态交付乙方使用。办
理
交
房
手
续
前,甲,乙双
方
必
须
清
查
该
物
业
及
其
内
部
所
有
设
施
的
运
行
情
况。
如
有
任
何
设
施
无
法
正
常
运
作,
则
应
被
视
为未
能
按
时
交
房,
直
至
视
察
时
所
有
设
施
及
设
备
均
呈
正
常
运
作
状
况。
在
此
情
况
下,
双
方
应
签
署
一
份
视察
情
况
记
录
一
式
两
份
并
且
作
为
本
合
同
的
一
部
分
以
示
房
屋
交
接
完
毕。
Party A shall deliver on schedule to
Party B the leased property in good
and
tenantable condition for Party B’s use. Prior to
hand over both
parties shall
participate in a walk through inspection of the
premises to
inventory all facilities
therein and ensure their proper working
condition.
Should any of
the facilities or fixtures not be in working
order the hand over will be deemed
incomplete until such a time as they
are in correct working order and
inspected. The inventory / hand over
inspection record will be made in
duplicate and forms an integral part of
this agreement.
8.2
租赁期内甲方不得无故收回租赁房屋。
(
除非本合同另有规定
)
Party A shall not take back the leased
property, without cause, during
the
term of the tenancy (unless otherwise stipulated
in this Agreement).
8.3
在乙方遵守本合同的条款及支付租金的前提下,乙方有
权于租赁期内拒绝甲方或其
他人骚扰
(
中华人民共和国法律规定除外
)
而安静享用租赁房屋。
在租赁期内,租客将在租期开始时搬入自己的家具并在租期结束时搬出
并承担此费
用。该条款在合同的其他条款适用。
Provided that Party B paying the rent
and performing and observing Party
B’s
terms
and
conditions
herein
contain
shall
peaceably ho
ld
and
enjoy
the
leased
property
throughout
the
term
of
this
Agreement
without
any
interruption by Party A
or any other person save and except as required
by the law of the People’s Republic of
China.
During
the
leased
term,
furniture
and
goods
of
the
occupant
will
be
delivered
to
the
apartment
in
the
beginning
of
the
Lease
Term,
and
taken out of the apartment, at its end
by his own expense and respecting
the
other
provisions
of
the
Agreement.
8.4
甲方应维修并保持约定之物
业外墙和主体结构,电力供应系统,有线电缆,下水道,
地板,水管和外部窗架在良好及
可使用状态下供居住人使用。租赁房屋的基本设施
和结构

包括非乙方原因损坏的家具和电器
)
损坏时
,甲方有修缮的责任并承担有关
的费用,并对其作定期修保。若修缮

天后此租赁房屋仍无法居住,甲方应提供乙
方一个同等于
租赁房屋每日租金的房屋或酒店使用。
To maintain and keep or cause to be maintained and
kept the outside
building main walls of
the said premises and the said building and the
main structure, electricity supply
cables, drains, floors, manholes,
water
pipes and exterior window frames of the said
building at all times
in a proper state
of repair and condition.
Party A is responsible for
repairing and maintaining the basic
facilities (including furniture and
appliances not damaged by Party B), the
structure of the leased property
and
for bearing all costs related thereto. During the
repair period,
Party A shall provide
Party B another premise or hotel at the same daily
rent if the leased property is not
livable after 7 days.
8.5
甲方谨在此声明及保证甲方为租赁房屋的合法拥有人并有合法
地位出租此租赁房屋予
乙方。就本合同及出租此租赁房屋予以乙
方之事,甲方已取得所有有关机构的批准,
包括政府批准及抵押权人的同意
(
如适用
)
。
Party A hereby represents and
warrants that Party A is legal owner of the
leased property and has the necessary
legal capacity to lease the property
to
Party B. Party A has also obtained all the
necessary authorizations from
all
relevant authorities in the People’s Republic of
China in respe
ct of
this
Agreement
and
the
leasing
of
the
property
to
Party
B,
including
government
approval
and
/
or
mortgage
consent
(if
applicable).
8.6
如在租赁期内,租赁房屋发生
所有权全部或部分转移、和其他影响乙方权益的事情
时,甲方应保证所有权人或其他影响
乙方权益的第三者,能继续遵守本合同所有条
款。如乙方于本合同下的权益受此等所有权
人或第三者所影响或损害,甲方须负责
补偿乙方的所有损失、损害、支出及费用。若甲方
出售该租赁房屋,则乙方承诺将
放弃优先购买权。
If during the term of the tenancy, all
or part of the leased property is
transferred or Party B’s right to use
leased property is affected, Party
A
shall
ensure
that
such
transferee
or
third
party
having
an
effect
on
P
arty B’s
right to use the leased property will continue to
abide by the
terms of this Agreement.
Party A shall
keep Party B indemnified
against
any costs, expenses, losses and
damages incurred to or suffered by Party
B
as
a
result
of
any
of
Party
B’s
inter
ests
herein
are
affected
or
prejudiced
by
such
transferee
or
third
party.
Party
B
hereby
agrees
to
give up
the priority of purchasing if Party A sells the
leased property.

期
间,甲
方
保证
提供
乙方承
租
的
房
屋是安全的
,且不会
因甲
方的原因干
扰
乙
方
的
正
常
居
住。如
因甲方的原因出现
周
围
房屋
的
影
响
,
导
致
乙
方
不
能
居住
,
乙
方
有
权
终
止
合
约。乙方须接受并遵守物业管理<
/p>
处之管理公约

During
the
lease
term
Party
A
must
guarantee
that
Party
B
can
live
safely
in
the
rented
premises
and
that
Party
A
will
not
disturb
Party
B’s
regular
dwelling
.
Party
B
has
the
right
to
terminate
the
agreement
should
the
gen
eral
living
conditions
surrounding
the
Premises
affect
the
Premises
in
such
degree
that
a
peaceful
living
cannot
be
obtained.
Party
B
shall
accept
and
abide
by
all
rule
and
regulations
of
the
Premise’s
management
.
8.8
甲方应根据中华人民共和国的税法规定负责缴纳对因乙方支付租金而可能产生所有
与租赁房屋有关的一切税项,包括但不限于土地使用费,房产税,印花税,营业税及企
业所得税。
甲方必须在收到租金后的七个工作
日内向乙方开具印有税务局监制章的正
式发票。如若拖欠有关发票,乙方有权延付租金。
Party
A
shall
be
responsible
to
pay
all
taxes
in
respect
of
the
leased
property
(including
but
not
limited
to
land
use
fee,
real
estate
tax,
business
tax,
stamp
duty
and
enterprise
income
tax)
in
accordance
with
the People
’
s
Republic of China tax laws and regulations. Party
A shall
provide
to
Party
B the
official
invoice
printed
under
the
authorization
of
the
relevant
tax
bureau
in
the
PRC
within
7
working
days
after
receiving the rental. In case Party A
fails to do so, Party B shall have
the
right to withhold any rental payment.
8.9
任何由于非乙方疏忽而造成
房屋内由甲方提供的如水、电、煤供应设施、供
应设备或电子仪器包括空调在内的电器无
法正常工作,乙方应及时通知甲方。
甲方必须维修恢复其正常使用,甲方应承担由此而引
起的费用。但因乙方疏
忽或使用不当而引起的该等保养、维修费用,甲方将不负责。

Should
any
of
the
services
or
facilities
such
as
water,
electricity and gas supplies and
supplied mechanical or electrical
apparatus
or
appliances,
including
air
conditioners,
provided
by
Party
A
in
the
Premises
fail
to
function
normally,
provided
that
such
mal-function
is
not
the
result
of
the
improper
use
or
the
negligence of Party B.
Party B shall promptly notify Party A, and
Party
A
shall
restore
the
normal
functioning
of
the
services
and
facilities
and
Party
A
shall
be
responsible
for
the
expenses
incurred. But Party A shall not be
responsible for maintaining and
repairing
the
said
conduits
and
pipelines
resulting
from
the
improper
use or the negligence of Party B.
九、
承租人的责任
Tenant’s
Obligations:
9.1
乙方应按合同的规定,按时支付租金,保证金及其它各项应付
费用。
Party B shall
promptly pay all rent, security deposit and other
charges payable by it in accordance
with the terms of this
Agreement.
乙方经甲方事
先同意
(
甲方不得无理拒绝或延迟给予乙方该同意
)
,可在租赁
房屋内进行软装饰装修及添置设备。租
赁期满必须恢复原状(正常损耗除
外),并承担其合理费用,经甲方验收认可后归还甲方
。
Party B may, with the
prior consent of Party A (such consent shall
not
be
unreasonably
or
delayed),
renovate
and
install
additional
facilities
in
the
leased
property.
Upon
expiry
of
the
tenancy,
the
leased
property
shall
be
returned
to
Party
A
in
its
original
conditions
(fair
wear
and
tear
excepted)
which
is
accepted
by
Party
A,
and
all
reasonable
expenses
arising
therefrom
shall
be
borne by Party
B.
乙方应爱护使用租赁房屋,如因乙方的过失或过错致使租赁房
屋及设施受到损坏(正常损耗除外),乙方应负赔偿责任。
Party
B
shall
treat
the
leased
property
with
care.
If,
as
a
result of
party B’s negligence or misconduct, the leased
property
and
the
related
facilities
suffer
any
damage
(fair
wear
and
tear
excepted),
Party
B
shall
be
responsible
for
compensating
Party
A
for such
damages.
