三、劳动保护和劳动条件

劳动保护设施,保
障乙方的安全与健康;

甲方根据国家有关规定制定工时制度,

则在当月

related
rules,
education
and
training
for Party
B.
四、劳动报酬
Labor
remuneration
根据“按劳分配”原则,实行同工同酬,乙方的报酬不得低
于当地最低工资标准。具体薪酬
标准、支付方式以及支付时间按公司制定的《薪酬管理制
度》执行。

the

distribution,
and
equal
pay
for

remuneration

Party
B
shall
not
be
lower
than
the
local
minimum
wage
standard.

五、社会保险
Social Insurance
甲方应按照国家有关社会保险的法律、法规和政策为乙方缴纳基本养老、基本医疗、失业、
工伤、
生育保险费用;
社会保险费个人缴纳部
分,
甲方从乙方工资中代扣代缴。
In
accordance
with
national laws, regulations and
policies
relating to social
insurance, Party A shall pay
the
basic
pension,
basic
medical,
unemployment,
work
injury
and
maternity
insurance
costs,
for the Party B;
social insurance premiums paid by individuals part

from Party B.
六、劳动纪律和规章制度

and regulations

、甲方依法
制定的
劳动纪律和
规章制度
,乙方有义
务遵守;
Labor discipline

regulations legally stipulated by
party A, party B shall have the duty to abide by
it.
2
、
签订本合同前,
甲方已对乙方进行了劳动纪律、
操作规程、
管理
制度等相应的培训;

signing this
contract, Party A has to provide party B the labor
discipline, operating
procedures,
management system and the corresponding training <

、乙方应当遵守甲方的工作操作规程,服从工作安排;
Party
B
shall
abide
by

working
procedures, obey the
work arrangement of party A.

、乙方违反劳动纪律或规章制度,甲方有权按本单位的规章制度,给予纪律处分,直至解除

If Party B violates labor
discipline or regulations, Party A is entitled by

rules of the unit to give Party A
disciplinary action, up to terminate this
contract.
七、劳动合同的变更

八、劳动合同的解除
The remove of labor

(一)双方协商一致,劳动合同可以解除。

(二)乙方
有下列情形之一的,甲方可以即行解除劳动合同:

严重失职、

negligence,

interests of the Party A.

、
乙方同时与其他用人单位建立劳动关系,
对完成本单位的工作任务造成严重影响,
或者经
用人单位提出
,拒不改正的;

refused to correct the
rules made by
the employer

、被依法追究刑事责任的。

(三)有下列情形之一的,甲
方可以提前
30
日以书面形式通知乙方解除劳动合同:

circumstances,

notice
to
inform

B
to
terminate
the
labor
contract ahead of 30
days.
1
、
乙方不能胜任工作,
经培训或调整工作岗位仍不能胜任工作的;
Party
B
is
not
competent
for work, after
training or adjustment of jobs.
2
、乙方患病或者非因工负伤,医疗期满后,不能从事原工作,也不能从事甲方另行安排工作
的;
Party B was ill or injured due
to non-work relation, after completion of medical,
Part A is not competent for his
original work, or alternative arranged jobs.
3
、
劳动合同订立时所依据的客观情况发生重大变
化,
致使劳动合同无法履行,
双方协商不能
就变更劳动合同达成协议的。

mutual

not
be
reached,
in change of this
labor contracts.
(四)有下列情形之一的,甲方可以提前
30
日通知工会,经工会同意后,与乙方解除劳动合
同:

agreement, Party A may terminate the labor
contract.
