Party B will carry the contract works as the drawings confirmed by Party A. Party B

will at any moment receive checks from representative or designated personnel of

Party A and make the checks convenient. Works should carry out to the National

required standard and design required.

Project quality should meet compulsory standards , other technical construction

standard for project construction and the regulations in this Contract. Otherwise Party

A is entitled to require Party B to dismantle and reconstruct the project. Party B shall

be responsible for all the expenses and loss (including delay of construction period)

incurred thereof. The representative of Party A is the responsible person designated

by Party A for carrying out the Contract.

The Project will be conducted in the way that all the materials will be provided by

Party B. The materials shall be those namedby Party A and shall satisfy national

standard with quality inspection certificate and product name specification , type ,

name, address of manufacturer marked in Chinese, and meet the requirements of

environment protection (include but not limited to the standards listed below:

GB18580-20XX;GB18581-20XX; GB18582-20XX; GB18583-20XX; GB18584-20XX;

GB18585-20XX; GB18586-20XX; GB18588-20XX). The materials and equipment for

decoration which are expressly eliminated by the State are prohibited from being

used. The main facing materials can be used only after the approval of Party A or the

supervising companydesignated by Party A. Those materials and equipment provided

by Party B that do not meets the requirements of quality

, or

there are discrepancy in specifications , should not be used. If this kind of materials or

equipment has been used, Party A is entitled to require Party B to dismantle and

reconstruct the project. Party B shall be responsible for all the expenses and

losses(including delay of the construction period) incurred thereof.

甲方有 权自聘工程监理，但须在工程开工前通知乙方，以便于工作衔接。

Party A is entitled to retain Project supervisor by itself , Party A shall inform Party B

before Commencement for the purpose of coordination.

甲方有 权按照工程建设质量安全监督管理的有关规定，到工程所在地的质量

门办理建筑装饰工程质量安全监督手续。

Party A is entitled to complete the formalities at the local quality & security supervision

authority where the project is located with regard to quality and security supervision

for the construction of decoration project.

乙方对 设计方案的可实施性和安全性承担全部责任，任何因设计方案无法实

施，修改方案导致的费用增加，

费用增加均由乙方承担。

Party B takes full responsibility for the feasibility and security of the construction

drawings. In case of loss and increased fees incurred due to unfeasibility and revision

of the drawings , and/or couldn ' t pass fire fight inspection etc , all the expenses and

losses are due to Party B.

方保证按照图纸施工，不得擅自改变设计图纸。

Party B shall ensure to conduct the construction in compliance with the drawings ,

which cannot be revised by Party B on its own.

During the construction , if Party A raise special construction tasks or special quality

requirements or drawing change, the Parties shall confirm together and shall

conclude supplementary agreement.

结

算时，如甲方及监理方发现有减少项目和数量，甲、乙双方确认后，减少

的费用应从

签订的合同中减除。

During the project checking and acceptance period , if Party A and project supervisor

find reduced construction tasks according to the signed

contract , the Parties shall confirm together and shall deduct the amount from the

contract.

第六条

双方权利义务

Rights & Obligations of Both Parties

1

、甲方权利义务：

Rights & Obligations of Party A:

配合办理施工报批相关手续；

To co-operate for the application of all necessary permits.

(2)

在收到乙方提供的装修图纸后合理时间内作出确认或提出修改意

见；

Confirm

or

raise

modification

suggestions

within

a

reasonable

period

after

receiving the decoration drawings provided by Party B.

(3)

按时支付工程款项；

To pay the contract amount to Party B as agreed.

(4)

协助乙方与甲方指定分包商的施工配合

To co-operate with other nominated sub- contractors.

(5)

组织工程竣工验收工作。

To organize contract works completion inspection.

、乙方权利义务：

Rights & Obligations of Party B

(1)

乙 方应当在合同生效后

日内按设计要求提供详细施工报批图纸 ，

以便甲方和业主审核，并在甲方和业主对装修图纸提出修改 意见后

改后的报批图纸。乙方应按经甲方和业主同意的施工图纸施工。

施工过程中的变更也应经过甲方和业主事先同意。

日内提供修

施工图纸确认后，

由于乙方的施工方案没经过业

赔偿将从

主及甲方同意，而造成的经 济损失，及对业主的赔偿责任由乙方承担。

合同的款项中扣除，

如不足以支付赔偿金额，

乙方还应补足余额。如果乙方未

能在 本条约定期限内提供详细施工报批图纸，则按第七条承担责任。

Party B should provide detailed construction drawings for report for approval to be

checked by Party A and the proprietary within 10 days after the Contract

becomeseffective , and provide modified drawings for report for approval within 3

days after Party A and the proprietary raised suggestions for drawings modifications.
